Many people associate deposit with a certain amount of cash. The general idea is that if you have the money to pay bail, you get arrested and get out of prison. Deposit is not a form of punishment, such as a penalty, and those who pay deposit are entitled to the money that is paid in return for the payment of a deposit, and abide by the conditions. For someone who pays bail, there are two possible outcomes: either the bail can be released or it can be forfeited. Deposit is complicated and deposit amounts can be very high.
The payment process requires you to travel to a specific location such as a courthouse or prison. Each jurisdiction has no rules on how bail is determined and released, nor does it have a process for making bail payments. A variety of bail types are available in some states and jurisdictions.
The payer hands over the deposit amount to a cashier, clerk or other official on site. The cash desk is responsible for receiving the deposit. The payer must provide the cashier with specific information, such as the name of the accused, the file number and the security deposit to be paid.
As soon as the prosecution receives the bail payment, it notifies the corrections officers who are holding the defendant in custody and releases the defendant from prison. In some situations this can happen once the officer is in the same facility as the prison, but in other situations it can take several hours or longer for the accused to be released.
Deposit payments can be made in cash or other forms of accepted payments such as credit or debit cards, certified cheques, travellers cheques and money orders. Accepted payment amounts vary from place of jurisdiction to place of jurisdiction.
